No Contact Provisions
If you do not have a lawyer representing you for your first court appearance, the judge will apply a “no-contact” provision. This will keep you from returning home, seeing your children, or speaking to your spouse. It is extremely important that you do not violate the “no-contact” provision under any circumstance, even if the alleged victim encourages you to do so. Violating the court order in any way can cause you to be arrested for violation of probation and may result in a charge of aggravated stalking.
Protective / Restraining Order Hearings
After an accusation of domestic violence, the alleged victim may apply for a restraining order or an injunction for protection. If granted by the judge, the restraining order will be issued on a temporary basis. A Protective Order Hearing will then be scheduled where the alleged victim will be served to appear at the hearing and testify to the reason for the protective order. At the hearing, the judge will hear testimony from the accused violent offender as well. It is important to have an Attorney by your side at this hearing.
